If the Supreme Court rules that the Federal Exchange does not qualify as an “Exchange established by the State” then all Oregon has to do is officially proclaim that it is establishing the Federal Exchange as Oregon’s State Exchange. The Oregon Director of Human Services and/or the Governor can likely do so. If not, the legislature can pass such a proclamation and the Governor can sign it.
This can be done right now, and would only be a positive no matter what happens. Once Oregon officially proclaims that it has established the Federal Exchange as its State Exchange with respect to all Oregon residents, Oregon will be just like states that established their own exchanges, for purposes of King v. Burwell. Oregon should do this tomorrow.
